Fair Campaign Hearing Process
The 2004 Legislature amended both the Minnesota Campaign Financial Reporting Act (Minn. Stat. Chap. 211A) and the Minnesota Fair Campaign Practices Act (Minn. Stat. Chap. 211B) so that after July 1, 2004, complaints about violations of both acts are to be filed with the Minnesota Office of Administrative Hearings rather than with county attorneys.
To initiate a complaint, a completed form must be filed with the Office of Administrative Hearings in person, by mail, or by facsimile transmission. Each complaint is subject to a prima facie review, meaning that the complaint must, on its face, state a violation of Minn. Stat. Chap. 211A or Minn. Stat. Chap.211B. Each complaint alleging actionable violations will be assigned for hearing. The time for a hearing will differ, depending on the proximity of the next election. The Fair Campaign Practice process is governed by Minn. Stat. Chapters 211A and 211B. The Office of Administrative Hearings process was added during the 2004 Legislative session. Both Chapters are provided to assist those persons who are using the process for resolution of alleged violations filed on or after July 1, 2004.
